As experienced real estate brokers in Western Colorado, one of the most common questions we get from potential clients is about the different types of real estate professionals and what they do. Two terms that often get confused are "real estate agent" and "transaction broker." While they may sound similar, there are some critical differences you need to understand as a home buyer or seller in cities like Grand Junction, Delta, Montrose, Rifle, Craig, and throughout Western Colorado.

What is a Real Estate Agent?

A real estate agent (also called a statutory agent in Colorado) has a legal fiduciary responsibility to their client. This means the agent must put the client's interests ahead of their own and cannot withhold any material facts about a property or transaction. An agent representing a buyer has duties to that buyer including utmost good faith, loyalty, and disclosure of all material facts that could influence the buyer's decision. An agent representing a seller has similar duties of accountability, obedience, loyalty, disclosure, and reasonable care and diligence.

As a Buyer's agent, we would assist you by:

  • Analyzing your wants/needs and finding suitable properties 
  • Arranging showings and negotiating on your behalf
  • Handling contracts and paperwork 
  • Advising you on prices, neighborhoods, market conditions
  • Looking out for your best interests every step of the way

As a Seller's agent, our duties would include:

  • Pricing your home competitively to maximize value
  • Marketing to attract qualified buyers 
  • Negotiating the highest possible sale price/terms
  • Managing contracts, disclosures, inspections
  • Providing Sound advice backed by local market expertise

In an agent relationship, there is a legal principal-agent relationship established through a written agency agreement. This outlines the duties and obligations of each party.

What is a Transaction Broker?

Unlike an agent who represents one party exclusively, a transaction broker in Colorado works with both the Buyer and Seller on a neutral basis throughout the transaction. A Transaction Broker is allowed to assist in the preparation of contract proposals, provide market info and data, issue disclosures, and facilitate the transaction through closing. 

However, they cannot make recommendations to influence a party in creating an obligation beyond the scope of the professional relationship. Their role is more limited - they facilitate the deal rather than representing either party's interests. 

Duties of a Transaction Broker:

  • Exercise reasonable skill and care
  • Account in a timely manner for all money and property received
  • Disclose to all parties adverse material facts actually known by the broker
  • Promote the interests of the parties with honesty, good faith, fair dealing and ethical conduct

As real estate brokers, we are legally required to discuss the different options for our representation at our first substantive contact. Colorado gives consumers the choice between client-level service with an agent or neutral facilitation with a transaction broker.  

In our experience, most buyers and sellers prefer to have an advocate on their side who will look out for their interests rather than a neutral facilitator. But for some, a transaction broker may be suitable if expectations and limitations are understood.
